In this regard, I would like to point out the opinion of the Legal Department of the FIR (Italian Federation of Citizen's Band transponder) that are written by the Association ... ... ... ... ... ... ... ... ... ... The opinion takes account of similar situations arising in our country and the ensuing outcome justice, always in favor of those who intended to install the antenna.
The installation, on part of an apartment building, an antenna system is intended to serve two-way radio equipment for private use is not prohibited by any law, therefore it is subject to common rules of civil law. Under of the above, the user of a CB unit may require establishing an own antenna on the common parts of the building, an easement that can be formed voluntarily or sets of fact. Accordingly (art. 174 and following of the Civil Code) none of the condominiums, which also have the right of the common parts of the building, can arbitrarily prevent the installation, remove the antenna installed or disturb the functionality.
That said, it should be noted that any antenna connected to a radio transmitting apparatus, performs a dual function. That is to transmit radio signals emitted by the device, and to receive incoming signals emitted from other transmitters or repeaters. Regarding the first function, the radio apparatus in my possession has the technical features required by DM 15-07-77 and 18-05-85. For the use of such equipment is provided for a permit issued by the Ministry of Post, and I hold, and the payment of an annual fee, paid by me regularly.
For the second function, namely the reception, there can be no doubt that the station operator has every right to listen to the various frequency ranges. Therefore it follows the full right to install a likely order.
In this regard, the Law 554/40 stipulates (art. 1) that the owners of a building or an apartment, non possono opporsi all’installazione di impianti d’antenna esterni, destinati al funzionamento di apparecchi radiofonici appartenenti agli abitanti (proprietari o meno) degli stessi stabili o appartamenti.
La Legge 554/40 modificata dal D.D.L. 382/46, sancisce anche una limitazione del diritto di proprietà, quale tipica servitù coattiva, relativamente all’installazione di antenne. La suddetta Legge prevede dunque l’obbligo per i proprietari e i condomini, di non dissentire all’installazione di impianti d’antenna esterni cui hanno diritto gli utenti di radioaudizioni.
La Corte di Cassazione (sent. 2160/71) ha riconfermato la giurisprudenza esistente. Pur chiarendo che non é esatto parlare di servitù coattiva imposta, ha sancito che la Legge attribuisce comunque il diritto agli abitanti dello stabile, all’installazione - e quindi anche alla manutenzione - degli impianti d’antenna, anche contro la volontà dei proprietari e/o degli altri condomini.
Per quanto riguarda la trasmissione, la disposizione é stata ripresa dal D.P.R. 156/73, il quale prevede (art.397) che nel regolamento attuativo dello stesso, ci possano essere disposizioni relative ai concessionari di servizi radioelettrici privati. In merito va rilevato che fin quando non entrerà in vigore questo regolamento, ed in mancanza di altre norme specifiche intermedie, si deve applicare quanto previsto dal R.D. 645/36 (art.179) per le concessione ad public use.
Consequently, according to art. 231-232-397 of the said Presidential Decree 156/73, the owner or the condominium, not object to the support on the property, antennas, support, and the passage of pipes, wires, or any other installation.
Finally, I conclude by ensuring that the installation of the antenna will be conducted with professionalism and criteria on the basis of the existing rules in order to ensure maximum safety and full efficiency for a long time.

1. Communications in "town band"-CB, in Article 105, paragraph 2, point p), are allowed to citizens aged 14 years the countries of the European Union or European Economic Area or countries with which have occurred reciprocal agreements, subject to the provisions of Article 2, paragraph 2, of Legislative Decree 25 July 1998, No 286, as well as residents in Italy.

Activities under Article 104 general authorization

1. The general authorization is required in every case in the following cases:
a) installation of one or more radio stations or on exercise of satellite and ground connections requiring an allocation of frequency, with particular reference to
1) fixed systems , land mobile maritime mobile, aeronautical mobile,
2) and radio-navigation systems;
3) space research systems;
4) systems for exploration of the Earth;
5) systems, space operations;
6) systems, frequency standards and signals times;
7) systems and aids to meteorology;
8) radio astronomy systems.
b) the installation or operation of an electronic communications network on a physical medium, carrier waves and optical systems, except as provided for in Article 105, paragraph 2, letter a);
c) the installation or operation of systems using frequency bands of a collective:
1) without protection from interference between users the same bands, with protection against interference from stations of other services, consistent with the statutes of the services provided by the national frequency allocation and the Radio Regulations, in particular belong to this class of amateur radio stations and the stations and facilities in Article 143, paragraph 1;
2) without any protection by low power devices. In particular, the general authorization is required if:
2.1) installation or operation of local networks to DECT or UMTS technology, with the exception of the provisions of Article 105, paragraph 1, letter a);
2.2) installation or exercise equipment as an aid to traffic and road transport and rail, security staff and the assistance on the roads, traffic surveillance, transport rope, monitoring of forests on hunting and fishing and safety at night;
2.3) installation or exercise equipment for use in industrial, commercial, agricultural and craft, including entertainment or broadcasting;
2.4) installation or operating equipment connected on the Safety of Life at Sea, or in any emergency, including small boats and stations located at sites of organizations as well as for marine service connections between different parts of the same ship;
2.5) installation or exercise equipment in use in sports and racing;
2.6) installation or operation of equipment to search people
2.7) installation or operation of equipment and medical aid to the professional activities to activities directly linked to them;
2.8 ) installation or operation of equipment for communications over short distances of a different type than those listed in numbers 2.1) to 2.8).
3) Without any protection, by means of devices complying with the recommendation of the European Conference of Postal and Telecommunications Administrations (CEPT) CEPT / ERC / REC 70-03 on the installation or operation of local networks or radiolan Hiperlan outside of your fund, or operating networks Hiperlan necessarily indoors or constraints resulting from requirements of the National Frequency Allocation.

3. In cases of applications for permission general services for land mobile or portable, shall apply only for the calculation of the maximum distance of the connection referred to in paragraph 1, letter b), paragraph 1 of 'Article 17.

Ci sono anche antenne "a frusta" per natanti e per automobili, quest'ultime costruite per sfruttare il piano riflettente della carrozzeria del veicolo. I trasmettitori tascabili (LPD, PMR) utilizzano antenne telescopiche o in gomma di piccole dimensioni e prestazioni ridotte. Al momento dell'istallazione l'antenna dev'essere tarata con uno strumento chiamato "rosmetro".
